MP-MPICH - MPI for heterogeneous Clusters

MP-MPICH ("the software") is licensed by the Lehrstuhl fuer Betriebssysteme ("the copyright holder") to the organzation ("the Licensee") to which you ("the Applicant") belongs at no charge for private, educational or commercial use. The commercial use in the sense of this license does NOT include the right to re-distribute the software (in whole or in parts). It DOES include the right to use the software together with freely and publically available third-party software for the Licensee's own commercial purposes in an environment which is under the Licensee's responsibility.

Thus, the Licensee has no rights to commercially distribute the software or derivative work in any form or use the software together with commercially distributed (not freely and publically available) third-party software which in turn accesses original or derivative functionality contained in MP-MPICH without written consent of the copyright holder.

The Licensee has the right to modify the software as long as the copyright holder is informed on these modifications and the modified software is made freely and publically available, including the full source code.

The Licensee agrees to include references to the copyright holder in any publications of research based on the software or parts thereof.

BECAUSE THE SOFTWARE IS LICENSED FREE OF CHARGE, THERE IS NO WARRANTY FOR THE SOFTWARE, TO THE EXTENT PERMITTED BY APPLICABLE LAW. EXCEPT WHEN OTHERWISE STATED IN WRITING THE COPYRIGHT HOLDERS AND/OR OTHER PARTIES PROVIDE THE SOFTWARE "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE IS WITH THE LICENSEE. SHOULD THE SOFTWARE PROVE DEFECTIVE, THE LICENSEE ASSUMES THE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.

IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW OR AGREED TO IN WRITING WILL ANY COPYRIGHT HOLDER, OR ANY OTHER PARTY WHO MAY MODIFY AND/OR REDISTRIBUTE THE SOFTWARE AS PERMITTED ABOVE, BE LIABLE TO THE LICENSEE FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY THE LICENSEE OR THIRD PARTIES OR A FAILURE OF THE SOFTWARE TO OPERATE WITH ANY OTHER SOFTWARE), EVEN IF SUCH HOLDER OR OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
